The Act—legislated as part of the American Recovery and Reinvestment Act of 2009, commonly referred to as the Stimulus or the Recovery Act—contains incentives to accelerate the adoption of electronic health record (EHR) systems by physicians and hospitals, and other incentives to facilitate health care information technology in general.
According to the Act, protected health information that's kept in an EHR system must be made available in electronic format to entitled individuals and businesses, as well as to any third parties they designate. Health care organizations are required to comply (subject to government sanctions) with the regulations established by the Act as well as to meet other, existing compliance requirements.
